  • If a person is not a director of a company or designated partner in LLP he must surrender his DIN/DPIN.
  • The person needs to apply for surrendering DIN and file Form DIR-5.
  • A declaration document that never been appointed as a director in any company should be attached.
  • Also, should declare that the DIN was never used in filing any document with any authority.
  • The government will verify e-records before deactivating DIN.
  • If a person was a director in any company using such DIN cannot be surrendered by filing E-form DIR-5.

CONDITIONS TO SURRENDER DIN

  • Having multiple DINs.
  • DIN was obtained in a wrongful manner or by fraudulent means.
  • Death of the concerned individual.
  • The concerned individual is declared as a person of unsound mind by a competent court.
  • That concerned individual has been adjudicated as insolvent.
  • The concerned individual is/was not associated with any company/LLP.

DOCUMENTS REQUIRED FOR SURRENDERING DIN

  • Identity proof of the applicant.
  • Voters ID/Driving License/PAN card.
  • Address proof such as electricity bill, telephone bill.
  • For Indian applicants, the recent documents should be attached.
  • Address proof should not be older than one year for foreign applicants while filing the eForm.
  • If the user wants to retain any DIN affidavit including declaration will be updated with all associated CIN/LLPIN.

ADDITIONAL DOCUMENTS (IF REQUIRED)

  • Copy of court order declaring DIN holder as insolvent/unsound mind if the Concerned individual is declared as a person of unsound mind by a competent court or has been adjudicated as insolvent.
  • Copy of death certificate on the death of the concerned individual.
  • Proofs that are in languages other than Hindi / English, should be translated in Hindi / English from a professional translator carrying his details (name, signature, address) and seal. In the case of foreign nationals, translation done by the notary of the home country is also acceptable.
